     Each and every person is expected to conduct themselves in a reasonable manner, so not to injure others.  If, however, a persons, through an act or omission, which is unreasonable under the circumstances, whether it be intentional or negligently, does injure another party due to that act or omission, the “tortfeasor” may be required by a court to pay money to the injured party.

     In Massachusetts a tort is committed where a person violates his/her duty to others created under the general and/or statutory law.  In order to have a claim for personal injuries in Massachusetts a victim must show four elements:
 
     1.  The existence of a legal duty owed to another;
     2.  The breach of that duty;
     3.  That the breach was "proximate cause" of injury suffered by the victim; and,
     4.  That actual injury (damages) uccured as a result of the breack.
